Cliff Gardner, Scott's direct appeals attorney, says in this June 10 article that he expects to file Scott's appeal later this month. The most recent request for extension of time was because the brief was due by June 1.

Seven years is considered lightning speed to file an appeal in a death penalty case in CA??? According to the linked article, it can be inferred that an innocent person can spend the rest of his/her natural life on death row waiting for ANY appeals to be filed and they can forget about having a lawyer appointed to help them any time soon. Of course, you have to hope that the appointed lawyer is competent if such a miracle occurs. Here I was thinking that Scott's appeal was dragging along at a snail's pace. Silly me.
I found the article interesting in that it sheds more light on a system that just doesn't seem to flow correctly. Add to that the fact that I am not a fan of the death penalty to begin with and with every informative article I read, I become less and less a fan. I wonder, how many innocent people have been executed in our country? That's something I'd like to try to research. I will remain optimistic in some type of positive outcome for Scott and his family. While I can't say, beyond a reasonable doubt, that Scott is guilty or innocent, I can say that I could have never convicted him, let alone sentence him to death, based on the factual documents and transcripts I have seen.
